Judge upholds decision to vacate A&B's permits

On Wednesday, July 7, the environmental court made it crystal clear to A&B that the court will be invalidating the permits that allow A&B to divert up to 45 million gallons of water daily from east Maui streams, more than half of which we find they are wasting.

The court is invalidating this year's permits because the Board of Land and Natural Resources denied the Sierra Club’s request for a contested case hearing. The court said the right to a contested case hearing is a crucial constitutional prerequisite to agency decisions, especially in environmental cases.

The Board's denial of our request for a contested case hearing violated our rights and means the permits were issued improperly.
